The Faculty of Law has a number of vacant Ph.D. scholarships available.
 
All research projects within the discipline of Legal Science are considered. However, the faculty will give priority to applications within the research areas of the Faculty´s research centres. The faculty?s research centres call for project proposals the following areas of research:
 
Centre for European Constitutionalization (CEC):
  • European Human Rights Protection after the Lisbon-Treaty
  • The institutional balance of power after the Lisbon-Treaty - a supranational / national
  • Power, democracy and the media - the right to be informed

Centre for Pension Law:
Change management in occupational pension schemes. The project may be limited to specific items, e.g.:
  • Under what circumstances may agreed conditions be altered by decision of the pension institute, the employer or the trade unions?
  • What is the impact of the act on the transfer of undertakings (virksomhedsoverdrag-elsesloven) for the continuation of existing pension schemes in mergers and acquisitions?
 
Pension conditions and actuarial decisions. The project may be limited to specific items, e.g.:
  • The relationship between the technical basis in life insurance and contract provisions.
  • What are the limits according to contract rules and under financial supervision for allocating bonus?
 
EU rules on free movement in occupational pension schemes
 
Liability of the pension institute for incorrect counselling. The project may be limited to specific items, e.g.:
  • Liability of the pension institute when the insured costumers are given the possibility to select a new scheme
  • Liability of specific costumers

Centre for Studies in Legal Culture:
  • Legal Knowledge 1: The importance of legal knowledge in the genesis of legal regulation and how this knowledge is competing with other forms of knowledge.
  • Legal knowledge 2: This Project involves an analysis of the importance of information systems for the way in which legal problems are analysed, adjudicated and decided.
  • Legal knowledge 3: An investigation of Case Law under Article 7 CISG (United Nations International Sales Convention), illuminating in particular the regard which courts and arbitral tribunals have to the international character of the Convention and the need to promote uniformity in its application, as well as the settlement of matters governed by the Convention but not expressly settled in it.   • Projects which entirely or partly falls within the fields of legal history, sociology of law and legal philosophy/jurisprudence or a combination of these. The Faculty of Law has furthermore the following Ph.D. scholarships within the area of Climate and Environment. These scholarships are financed partly through the Danish Agency for Science, Technology and Innovation:
 
Topic 1: Climate Convention, Kyoto Protocol and after 2012
a. Comparative analysis of the Kyoto-protocol and the EC Directive on emission
trading - could the principles for emission trading within the EC be transferred into a global regime?
b. Enforcement of the international obligations under Kyoto and the EC-obligations to reduce greenhouse gas emission - from a macro as well as a micro perspective
c. How to deal with greenhouse gas emission from maritime and aviation transport in the future: - within or outside the scope of the Climate Convention, cap and/or taxation   

Topic 2: Climate and Sustainable Energy Use
a. CO2 storage and the legal challenges in an international, EU and Danish legal perspective, including the licensing regimes, liability and relation to the CO2-quota regime.
b. Energy efficiency, conservation and demand control and an analysis and evaluation of the regulatory instruments in an international, EU and Danish comparative legal context. Issues related standard harmonisation, requirements to exclusion of ineffective products and the relation to international trade and free competition should be incorporated.
c. Renewable energy and an analysis of the different legal problems each energy form gives rise to e.g. biofuels, solar and wind energy. How do requirements and support systems play together with an open energy market, public service-obligations, physical planning and private property rights?
d. How is a reliable energy supply ensured within the framework of EU with its trans-boundary infrastructure, and how does it fit into a global liberalised market? An analysis of the external and administrative competence of EU and the member states? authorities should be included together with the correlation to the internal market, nature and planning legislation.
 
Topic 3: Climate, Renewable Energy and Regulation of Energy - Emission Trading.
a. Emission trading in an International Law and EU law perspective.
b. Emission quota for greenhouse gasses: - legal status, allocation, banking, trading and revocation.
c. Emission trading and state aid - how to comply with polluter pays principle.

The Faculty?s Ph.D. Programme
The purpose of the Faculty?s Ph.D. Programme is both to prepare the student for a continuing career in legal research and teaching and to educate highly qualified labour relevant to both the public and private sectors. The degree assures research qualifications at an international level.
 
Qualifications
  • Applicants must have an educational background that corresponds to the Danish LL.M.-degree or equivalent qualifications.
  • Students who are expecting to graduate this term and are awaiting the evaluation of their dissertation may apply.
  • Applicants must document an aptitude for scientific work, for instance through a high assessment of their dissertations and must also be able to undertake the highly demanding task of independently writing a Ph.D. dissertation.
 
During the 3-year Ph.D. Programme you are required to
  • Participate in research environments outside the Faculty of Law - usually through study periods abroad.
  • Complete the Faculty?s Ph.D. study Programme - some travelling including to international conferences, courses, and meetings should be expected.
  • Teach - typically bachelor or master courses.

Terms of employment
Employment will take place according to the agreement between The Danish Confederation of Professional Associations and the Ministry of Finance about the salary of Ph.D. Students. Furthermore, there will be a personal pension bonus corresponding to the difference between the seniority increment received as a principal according to the new wage system for academics on a group contract basis and the pay of a Ph.D. student. The scholarship can normally not be extended.
